I think based on the design of industrial ships it's pretty safe to assume that mining to a can was not an exploit.
1. industrial ships only purpose is to haul, and most often haul ore/minerals, if mining to a can was an exploit and industrials only purpose would be to go from station to station.
2. you have to mine to a can in 0.0 mining the rare ores (cause there are no stations there <- little explanation for the really dense or really stoned), the can may not be in the belt but it is somewhere in the system
3. and the best point i can make is that secure cans and other anchorable cans were not around until oct 2003 so you had to mine to a jettisoned can, there was no other option.
If it were possible to transfer contents of your cargo to another ships cargo hold without using a can I could see how mining to a jettisoned container could be an exploit. But pre oct 2003 miners deep in 0.0 had no alternative other than mine to a can, so being this was the only option there is no way it could be considered an exploit. The fact that it also works in high security had to have been known by the dev team way back before beta (although I wouldn't doubt it iff.... umm i'll stop there).
So back before secure cans deep in 0.0 you could either a) mine to a can and have an industrial pickup b) mine your full cargo and head back a bunch of jumps
as you can see option "b" isn't really an option so as far as methods of mining go if people were exploiting can mining they were exploiting there only option.
The fact that it works in high security space is irrelevant because the dev team had to know that since this was the only real option in 0.0 that it would have been used in high security as well. What the hades would anyone want an industrial for anyway if the purpose was to haul only from station to station.
So in summary, you are stupid.
CCP defines an exploit as using the gmae mechanics in a way they didnt intend. They did not intend people to mine into jet cans, therefore it is an exploit. But isnt deemed an offence by ccp.
Now picking something out of a can isnt an exploit as this is what ccp intended, thats why ore stealing isnt an exploit.
Im suprised somebody hasnt come up with the argument, "the can has my name and corp tags on it, therefore its my property". The reason cans have tags on them is simple, a long time ago people were getting ****ed off about not being able to tell which loot can belonged to whom and which ones to npcs, so ccp tagged them. Btw, it wasnt for miners that the tagging of cans was implemented
